These Terms & Conditions apply to your use of the CASHMERISM website and to purchases made through our online store.

Please read these Terms & Conditions carefully before using our website or placing an order. By accessing, browsing or using our website, or by placing an order with us, you agree to be bound by these Terms & Conditions and the policies referred to in them.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law (ACL) or any other law that cannot legally be excluded, restricted or modified.

In these Terms & Conditions, “CASHMERISM”, “we”, “us” and “our” refer to Unique On Pty Ltd trading as CASHMERISM.

Our website is powered by Shopify, which provides the ecommerce platform that enables us to sell our products and services to you.

You may use our website for lawful purposes and in accordance with these Terms & Conditions.

You may be able to create a customer account with CASHMERISM.

You agree to provide information that is accurate, current and complete and to update your information when necessary.

Please contact us promptly if you believe that your account has been accessed without your permission.

4. OUR PRODUCTS

We take care to provide accurate product descriptions, photographs, colours, measurements and other information on our website.

However, the appearance of products may vary slightly depending on your device, screen settings, lighting and other factors.

We may also make reasonable changes to product descriptions, specifications, colours or designs from time to time.

Where a product is made from natural fibres, including cashmere, wool, yak, cotton, silk or linen, natural variations in colour, texture, handle and appearance may occur.

These characteristics are part of the nature of natural fibres and do not necessarily indicate a manufacturing fault.

5. CASHMERE & NATURAL FIBRE CHARACTERISTICS

CASHMERISM garments are made using natural fibres and are designed to be worn and enjoyed over time.

Cashmere and other natural fibres may develop some pilling, particularly when new or where the garment experiences friction from areas such as handbags, seat belts, jewellery or other clothing.

Pilling is a natural characteristic of many fine natural fibres and is not necessarily a product fault.

The way a garment is worn, washed, dried and stored can also affect its appearance and longevity.

Please follow the care instructions supplied with your garment and the recommendations on our How to Care page.

If you believe your garment has a genuine manufacturing fault, please contact us so that we can assess the matter.

6. PRODUCT MEASUREMENTS

Garment measurements provided on our website are intended as a guide.

Because our garments are knitted, measurements may have a small degree of variation and can be affected by the way a garment is laid or measured.

If you require additional measurements before purchasing, please contact our team and we will be happy to assist where reasonably possible.

7. PRODUCT AVAILABILITY

We make every reasonable effort to ensure that stock availability shown on our website is accurate.

Occasionally, stock discrepancies may occur, particularly where an item is purchased by more than one customer at approximately the same time.

If an item you have ordered becomes unavailable before we can fulfil your order, we will contact you as soon as reasonably possible.

Depending on the circumstances, we may offer:

An alternative product
Delayed shipment where additional stock is expected
Cancellation and a refund for the unavailable item

8. PRICING

All prices displayed on the CASHMERISM Australian website are in Australian dollars (AUD) and include GST where applicable.

Prices may differ between our website, CASHMERISM stores, authorised stockists and other sales channels.

Prices may change from time to time. Any price change will not affect an order that we have already accepted, except where an obvious error has occurred.

We take reasonable care to ensure that pricing information is accurate. However, an occasional typographical or technical error may occur.

If we identify an obvious pricing error before an order has been accepted or fulfilled, we may contact you to confirm whether you wish to proceed at the correct price or cancel the affected order and receive a refund.

Your rights under Australian Consumer Law are not affected.

9. ORDERS

When you place an order through our website, you are offering to purchase the products selected by you.

After submitting your order, you will receive an email confirming that we have received your order.

This confirmation acknowledges receipt of your order and does not necessarily mean that your order has been accepted.

An order will generally be accepted once we have successfully processed payment and confirmed the order for fulfilment.

We may need to decline or cancel an order where, for example:

A product is unavailable
There is an obvious pricing or product information error
Payment cannot be successfully processed
We reasonably suspect fraud or unauthorised activity
We are unable to fulfil the order for reasons outside our reasonable control

If we cancel an order after payment has been received, we will arrange a refund for the amount paid for the cancelled products.

10. CANCELLING AN ORDER

We begin processing orders as soon as reasonably possible.

If you wish to cancel an order, please contact us as soon as possible at info@cashmerism.com.au.

We will do our best to accommodate cancellation requests received before an order has been processed or dispatched. However, we cannot guarantee that a cancellation will be possible once an order has entered processing or has been dispatched.

If an order cannot be cancelled, you may be able to return the product in accordance with our Returns & Exchanges policy, subject to the applicable conditions.

Your rights under Australian Consumer Law are not affected.

11. PAYMENT

Payment must be made using one of the payment methods available at checkout.

Payments may be processed by third-party payment providers.

CASHMERISM does not store your complete credit or debit card number or security code on our own systems.

You confirm that:

You are authorised to use the payment method
You have sufficient authority to complete the transaction

If payment is declined or cannot be successfully processed, we may be unable to fulfil your order until payment has been successfully completed.

12. PROMOTIONS & DISCOUNT CODES

From time to time, CASHMERISM may offer promotional pricing, discount codes, special offers or other promotions.

Unless otherwise stated in the relevant promotion:

Promotions are valid only during the advertised promotional period
Promotional offers cannot be combined with other offers or discount codes
Discount codes must be entered at checkout where required
Promotions may apply only to selected products or customers
Promotions may be subject to minimum spend or other stated conditions
Promotional discounts cannot generally be applied retrospectively to previous purchases

Where a promotion has specific terms, those terms will apply to that promotion.

We reserve the right to correct genuine errors in promotional pricing or promotional information.

13. SALE & FINAL SALE PRODUCTS

Products marked as SALE or FINAL SALE may be subject to different change-of-mind return and exchange conditions.

Please refer to our Returns & Exchanges policy for the current conditions applicable to sale and final sale products.

A sale or promotional price does not remove or reduce your rights under Australian Consumer Law.

If a product is faulty, unsafe, significantly different from its description or otherwise fails to meet a consumer guarantee, you may be entitled to a remedy regardless of whether the product was purchased at full price, on sale or during a promotion.

14. SHIPPING & DELIVERY

We offer shipping options and estimated delivery timeframes as displayed on our website at the time of purchase.

Delivery times are estimates only and may vary depending on destination, carrier capacity and circumstances outside our reasonable control.

Delays may occur due to circumstances including:

Postal or courier delays
Severe weather
Natural disasters
Customs processing
Industrial action
Transport disruption
Other events outside our reasonable control

Where tracking is available, we will provide tracking information once your order has been dispatched.

If your order is significantly delayed or does not arrive, please contact us so that we can assist with the relevant delivery provider.

15. INTERNATIONAL ORDERS

International customers are responsible for ensuring that products purchased from CASHMERISM may legally be imported into their destination country.

International orders may be subject to customs duties, taxes, import charges or other fees imposed by the destination country.

Unless expressly stated otherwise, these charges are the responsibility of the customer.

International delivery timeframes are estimates and may be affected by customs processing and other circumstances outside our control.

16. RETURNS & EXCHANGES

Our change-of-mind returns and exchanges are governed by our separate Returns & Exchanges policy.

Please read that policy before purchasing.

Our change-of-mind policy is separate from your rights under Australian Consumer Law.

If a product is faulty or otherwise does not meet a consumer guarantee, please contact us as soon as reasonably possible so that we can assess the issue and provide an appropriate remedy.

17. AUSTRALIAN CONSUMER LAW

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable laws that cannot legally be excluded, restricted or modified.

Consumer guarantees may apply to products purchased from CASHMERISM.

Depending on the circumstances and the nature of a problem, you may be entitled to a repair, replacement, refund or another appropriate remedy.

The remedy available will depend on the circumstances and the requirements of applicable law.

Our voluntary change-of-mind returns and exchanges policy does not replace or limit these statutory rights.

18. GIFT CARDS

CASHMERISM gift cards may be purchased and redeemed subject to the specific terms displayed with the gift card.

Unless otherwise required by law:

Gift cards cannot be exchanged for cash
Gift cards cannot be used to purchase another gift card
Gift cards should be treated as cash
CASHMERISM is not responsible for gift cards that are lost, stolen or used without authorisation

Any expiry date and applicable conditions will be clearly communicated at the time of purchase.

Gift cards cannot be used in conjunction with promotions unless the relevant promotion expressly permits their use.

Nothing in this section limits any rights provided by Australian law.

19. VIP & LOYALTY PROGRAM

CASHMERISM may offer a VIP or loyalty program from time to time.

Membership, points, rewards, discounts, benefits and eligibility are subject to the specific terms of the relevant program.

VIP benefits may include discounts, shipping benefits, gifts, early access and other privileges as communicated to members.

We may suspend or terminate a membership where we reasonably believe there has been fraud, abuse or misuse of the program.

20. GIFTING & GIFT RECIPIENTS

Where you purchase a product as a gift, you are responsible for providing accurate delivery information.

If you provide us with personal information about a gift recipient, you should ensure that you are authorised to provide that information.

Gift recipients may be subject to the same return and exchange conditions applicable to the original purchase, unless otherwise required by law.
